Terms and conditions

These terms are the agreement between you and Picture Medic ("we", "us", "our") for the use of picturemedic.com and the photograph restoration service offered through it (the "service"). By creating an account or sending us a photograph you accept these terms. If you do not accept them, please do not use the service.
1. Who we are
Picture Medic is an online photograph restoration service, operated from Kuwait. You can reach us at hello@picturemedic.com or through the contact page.
2. Who may use the service
You must be at least 13 years old, and able to enter into a binding agreement, to hold an account. If you are under 18, please use the service only with the involvement of a parent or guardian. If you use the service for an organisation, you confirm you are entitled to accept these terms on its behalf.
3. Your account
One account is for one person. You agree to:
- Give us an email address that is really yours and that you can receive mail at.
- Keep your password to yourself, and tell us promptly if you think someone else has it.
- Accept responsibility for what is done through your account.
We may suspend or close an account that gives false information, breaks these terms, or is used to harm the service or anyone else.
4. What the service does
You send us a photograph; we repair the damage in it and send the result back to you. Repairs typically include scratches, dust, speckling, creases, tears, stains, fading and colour casts, and making faces clearer. You choose how strongly to repair, and whether the result should be in colour or remain monochrome.
We do not promise a particular result. Photograph restoration is judgement work: the amount that can be recovered depends on the photograph you send, and on how much real detail is left in it. We will not invent detail that is not there, and we will not change who people are or what they were doing at the moment the photograph was taken. If a result disappoints you, the first thing we do is repair it again at no cost. See the refunds page.
5. Free repairs
Every photograph you send us is repaired free of charge, and there is no limit on how many you send. The repaired photograph is returned with a watermark across it, the word picturemedic.com, repeated. It is for you to keep and print, and to see whether the service suits you; it is not for resale and the watermark must not be removed or covered.
6. Prices and payment
- Repairs are free. What is sold is the clean copy, without the watermark. Its price will be shown to you before you pay.
- Prices are in United States dollars (USD).
- There is no subscription and nothing renews by itself. You pay for the clean copies you want, when you want them.
- Payment will be taken by our payment provider. Nothing is charged until you pay, and the clean photograph is made available once the payment has gone through.
- Where a payment provider or tax authority requires it, taxes will be shown before you pay.
7. Your photographs, and your rights in them
Your photographs remain yours. We claim no ownership over them, and we do not use them for anything except producing your result and keeping your account working.
By sending a photograph you confirm that:
- You own it, or you have permission from the person who does.
- You have the right to have it repaired, and to let us process it for that purpose, including the consent of any living person who is clearly identifiable in it.
- It is not unlawful, and it is not abusive material of any kind.
You give us permission to store, process and forward your photograph strictly as needed to repair it, email it to you and show it back to you in your photographs page. That includes passing it to the image-processing provider we use for the repair itself, this is explained in the privacy policy. This permission lasts until the photograph is deleted from our servers.
8. What you must not send us
Please do not send photographs that are unlawful, that you have no right to copy or repair, or that show cruelty, abuse, or any sexual content involving minors. We may refuse any photograph, and report anything unlawful to the relevant authorities.
9. Fair use of the service
You agree not to:
- Use automated means (bots, scripts, scrapers) to create accounts, send photographs or take data from the service.
- Attempt to reach parts of the service, or other people's photographs, that are not yours.
- Resell, resupply or redistribute the service without our written permission.
- Interfere with, overload, or try to break the service or its infrastructure.
- Remove, obscure or crop out the watermark on a free copy in order to avoid paying.
10. Refunds
Our full policy is on the refunds page. In short: your first photograph is free, a disappointing result is repaired again at no cost, and if we still cannot give you a photograph you are happy with you get your money back.
11. Our intellectual property
The Picture Medic name, logo, website, design and software are ours, and are protected by copyright and trademark. These terms do not give you any rights in them beyond using the service as described here. Once you have paid for a clean copy of your own photograph, you may use that result freely and for any lawful purpose.
12. Availability and changes
We may add to, change, or withdraw parts of the service. The service is provided "as is" and "as available": we cannot promise it will be uninterrupted, or that every photograph can be repaired. Where we can, we will give notice of significant changes, and we will not take away a clean copy you have already paid for.
13. Limits of our liability
- We are not liable for indirect or consequential losses, loss of profit, or loss of data beyond the deletion promise in the privacy policy.
- Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars (USD $50.00).
- Nothing here limits any liability that cannot be limited by law.
14. Your responsibility to us
If a claim is brought against us because of a photograph you sent, or because you broke these terms or someone else's rights, you agree to cover our reasonable costs and losses in dealing with it.
15. Closing your account, and ours
You may close your account whenever you like by writing to us. When an account is closed, the photographs held for it are deleted in line with the privacy policy. We may suspend or close an account that breaks these terms, for example by sending unlawful material, by trying to abuse the service, or by trying to avoid paying for clean copies. Where we close an account for breaking these terms, amounts already paid are not refunded.
16. Governing law
These terms are governed by the laws of the State of Kuwait, and any dispute arising from them falls to the exclusive jurisdiction of the competent courts of Kuwait. Before starting formal proceedings, please write to hello@picturemedic.com and give us the chance to put things right.
17. Changes to these terms
We may update these terms. When we do, the "last updated" date at the top of this page changes, and for material changes we will tell you by email or with a clear notice on the service. Continuing to use the service after that means you accept the updated terms; if you do not accept them, please stop using the service and close your account.
18. General
- The whole agreement: these terms and the privacy policy are the whole agreement between us about the service.
- If one part fails: if a provision is found to be unenforceable, the rest of these terms stay in force.
- No waiver: if we do not enforce a right once, we have not given it up.
- Transfer: you may not transfer your rights under these terms; we may transfer ours if the business is sold or merged.
- Beyond our control: we are not liable for delays or failures caused by events outside our reasonable control.
